Sorry it had to go down like this and sorry you are so upset. 

But let me break this down for everyone...I PM'd you and emailed you on the 13th of Nov because I had not received anything and you said on Nov 1st that you would get it right out.

I again PM'd and emailed you on the 17th and I had been calling you for over 2 weeks with no response.  I felt I was being ignored.  Not until I posted this on ATVFL did I receive anything from you.  On Nov 19th I received a response from you saying that it was going out by UPS.  I got everything a few days later and was very happy that it finally worked out.

Now, I will say sorry that I did not remove your personal information sooner...to be honest, I completely forgot that I had posted it or I would have removed it as soon as I got your PM on the 19th.  I have now removed it as it does NOT need to be posted on the internet.  You have to understand, I picked up the bike on the 16th of Oct and didn't receive a tracking number for the stuff until the 19th of Nov...that is over a month and a little long.

I am very sorry about your family problems, as I expressed in my PM, I feel for you as I am going through a similar situation with my wife's grandfather.

Please understand, this was not an attack on you or way to "bash" you on the internet but I was very concerned that I had a stolen bike OR you took the money and ran....which as I know now, is not the case.

Bump...just in case.

Don't want this thread to get removed due to inactivity.  I am still waiting on the title but per seminolewind, he only owes another $200 and he will be getting the title.  I explained that I needed it asap because I am going to either sell the quad or trade, as I have lost interest in sport quads.

All I have is a bill of sale, what rights do I have?

You've got to be freaking kidding. This bum still hasn't sent the title. If it were me, I would be traveling up north and  getting this settled.
You have absolutely no leg to stand on whatsoever. If the loan is not paid off then the bank will come for the quad. Your only chance is to pay the bank the $200 and get the title. Then take it out of his hide.

I don't think the bank will go after the quad especially for 200 bucks they will go after the name on the loan papers.

I think it should be a crime to sell something you have if you don't have the title IN HAND!!! Im not saying this guy is scum of the earth, but its pretty messed up of him to sell it and not pay off the loan right away. Seems to me that YOU are helping him out of a mess he got into by financing the quad and selling so soon.

Yeah, I got a receipt (bill of sale) a few weeks later.  Well, here as of late he has been very fast to return my PM's so I am happy about that.  He said he will pay it off on Monday and I will get my title.  Can't wait...

I sold stuff on e-bay for a while.If you paid via paypal there is Buyer Protection to some extent.It may be to late but if you file a complaint & the guy has money tied to his paypal from bank account CC or other they may withdraw the funds & hold them while the dispute is settled.If not this time hopefully there wont be a next!

If you paid via Paypal, buyer protection would not help you in this case (unless you purchased this at the time), you can dispute these transactions though. If he has some or all the money in his paypal account (which is doubtful - but worth a try) it is very simple to do and it would be very easy to recover your money.

Log into your paypal account and click the resolution center tab and then click the link to "file a claim" and follow the instructions.

Other options (well financial ones) depend on how you funded the paypal payments. If it came from a bank account - or was transferred from someone else's paypal account then the above action is all paypal can do for you, if however you funded the paypal transaction via a regular credit card, you can initiate a chargeback through them too.

I filed a complaint with PayPal some time back and they couldn't do anything.  If I don't get it soon, I am going to take him to court.  I have all of the documentation from conversations.  I told him today that I was going to take him to court if I don't get some action and he then replied.  I have PM'd many times with no response, now he says, it take 30-60 days for the company to release the title, but assures that it is on the way to him and he will overnight it to me.

FYI, it is absolutley against the law to sell a vehicle/machine whatever with a title that has a lien on it...When you go the DMV you sign a waiver stating their are NO liens of any nature on the said property.Check it out.I'm 110% positive..

FWIW, I purchased a vehicle from a member on here(QuadFaja) and he had to pay FAR more than this kid had pay on top of it to settle the loan.He did it right off the bat...Ya gotta be careful...It's your problem should they flake out.

On the other hand, it does take some time for the banks to "get around" to sending a title out that is paid off..They could careless.You could call for verification though..piece of mind at least.

If someone selling a anything and they do not have the title because a bank or finance company has the title, then the business in posission of the title owns the quad. The person with the bike, but not the title has no right to sell the bike. They do not own it, whoever has the title owns it.

I just went to the tax office and registered for title 3 quads. The one I got used from a guy recently. The very first thing that happened on the DMV computer was a pop up on the screen asking for the date that the lein was paid off.

When and if this guy ever gets the title, he will also get a letter from the finance institution stating that the loan or lien has been paid off.

YOU NEED TO GET A COPY OF THIS STATEMENT FROM HIM ALONG WITH THE TITLE. Also, you will not be getting a title, but a "certificate of origin" from the manufacturer. If he does not send you this lien paid off statement, you need to request from him the date it was paid off.

As you have the loan company info and this guys name, I suggest calling them and explaining your situation. I doubt they will come after the bike, but will get on this guy or advice you.

It only took 2 weeks to get my new title for a boat that I bought used. NEVER EVER leave a situation without a written bill of sale, you can write it on notebook papare & it will hold weight. If it were me I would have met him at the bank or the Honda shop he bought it from & you could have made sure of the payoff & title to be sent to you asap. You said he met you halfway, well that extra tank of gas isnt looking so bad now. He may be telling you the truth, but the price you paid sounded to good to be true & now we all know it was. If it were me I would drive up there & pay the bank the extra $200 & get the title & write it off as a lesson learned. good luck. SEMINOLEWIND, get the man his title, he didnt meet you all that way with that much cash to get hosed by a liar. Make it right.
