Boy did I get screwed...

I bought a pair of custom axis shocks off of ebay and the guy ended early because he needed the money and because I wanted the shocks...well he never shipped them and ebay banned him so per paypal, there is nothing they can do.  I just lost $765 I am so upset.

I have been calling the seller and he wouldn't answer anymore...just VM.  So I tried *67 and he answered...when I told him it was me, he hung up

Wish there was something to do...just wish I lived in ohio...I would drive to his house and beat his a$$....guaranteed

I am so upset right now, I mean, I have a newborn baby here and every penny counts.  I only have so much I can spend on my bike and for something like this to happen, almost makes me cry...seriously

I have a dispute with paypal and have had one but unless he puts the funds back into his account, all they can do is close his account from further use.

Any suggestions...I am at a loss.

Do you really think so?  I do know his first name..Chad.  The paypal account is under his wife's name...Lisa Pauli.  He lives in OH and I have his cell phone number.  All I have is his email addy and cell number.  I am sure paypal could give me the rest.

I had the same thing happin to me on ebay, won a bid, and he never sent the item.  Tried going through Pay Pal and EBay to get my money back with no results.  But, my PayPal account is set up with my American Express card after disputing with the credit card company I recieved a hold on the money withdraw and a couple of months later was credited back to my card.  PayPal and Ebay's policies on this sucks, luckily I have a good credit card company.

Man, Mike that sucks. I went through a paypal dispute once and it took months! Like they said, if you used your card you can dispute the charge through them and that is probably the best you can do for now. Even if you went after him in court, you will spend more money fighting it than you lost in the first place.

You need to contact the local authorities and talk to someone about it. You may even try to get ahold of someone at your county court house and try to get some infl through the small claims dept. They may not be able to do anything but i would bet you could get some useful info. This is so common nowadays that theres got to be somethin, you cant tell me that paypal is givin you the  song and dance. They have to accept some degree of responsibility, or atleast make his personal info available to you, so you can take legal action. I would think. Its just cant be a "we cant help you" type of deal. If so, they would be enabling that type of business to take place.

If you have his name and get proof of payment, you can file a small claims with the court and they'll make him pay .He's probably expecting you to do nothing...take the azzhole to court!!
 It does cost like $400 to file a claim.The amount depends on how much your trying to get back.
 I sold a so called friend a car of mine and he still owed me $2500. cash.He tried to split with my ride.It was like $400. to file the claim, but I got my car back...didn't even need a lawyer.

Also, save your e mails! He ended the auction early so he may try to say that he never sold the item to you. If you guys had an agreement via e mails you need to save every one he sent you and you sent to him. Sorry that this had to happen to you man. E-bay can be good to you, then it can bite you in the arse when you least expect it    .

you can always bring him to small claims court for the cost of several hundred dollars and get a judgement against him.  File the case in fla, he will never attend, you will get a judgement against him, file it in the county he lives in ohio and he will never be able to buy a house until your judgement is paid off and you can collect interest at I believe 8%. You even be able to sell your judgement at a discount and have a collection firm go after him and make his life miserable.  Also try calling directory assistance and give them the # and ask for the address of the #.

WOW...thanks for all the responses!!!!  I have to say reading this has made me feel alot better about the situation. 

Paypal still won't do anything...tried calling again today.  I do however have more info on the guy like full name...  I would love to drive to OH and pick up my shocks and definitely will consider that...depending on how things go.

Hey Mike, that sounds like a great idea man.  Anyone wanna help with Mikes plan, IM me and I will give you all of his info...this way, it gets done faster!  lol

I will keep each and everyone of you up to speed as this goes along.  I do appreciate all of your responses and I am looking into all of them...from traveling to kick some arse, to taking him to small claims, to having gay people call him...lol
