on june 19th  6pm ,the city of north port commisioners will decide to adopt an ordinance to ban all camping and all atv/off-road riding within the city limits on public and private land. the north port off-road association is trying to secure a riding area close or within the city limits legally and is working with one of the commisioners to make this possible. the fines for theses ordinances start with a warning and can lead to jail time.the NPPD have been for several months been running off riders in the area and this ordinance will give them too much authority. i dont want our tax dollars used against us and our families.please contact the north port commisioners and if possible ,join us june19th at 6pm at the north port city hall to show your support...thanks,jetski

north port cops and commissioners are a$$holes  they ticketed my raptor buddies for crossing the road by tittie lake(their own fault) now their $150 in the red. but i personally have ridin out their since the late 80's and a cop chased us in to titie lake only because a cruiser was stuck. so the cops says it's ur lucky day and i tell him it;'s ur lucky day pal .he throws his gun in the car and me and my buddy push him out and he says u can ride here today. i said yeah right dumbass learn to drive ur cruiser or next time call a wrecker.all the support on the 19th wont help ,their gonna do what they want but they'll never stop it totally. just park on private property and ride safe

i agree 4.. but the NPPD will cite you even on private property unless you show proof that you own it or have a letter from the owner ,if this ordinance is passed. plus, there wont be any camping allowed. that goes for everybody, including scouts.

I think you guys need a rally / protest !  Look what happened in Collier County, if it wasn't for the rally / protest we had Picayune would have been history.

Can you post the address to city hall? I'm not familiar with the area. I will e-mail the commissioners voicing my opinion...

http://Hello,

I'm a reporter with the Norrth Port Sun, and I am covering the issue of ATV riding here, including the current enforcement by police and the proposed ATV and Camping ordinances.

I am interested in speaking with anyone who has challenged a ticket and won.

I am looking for people who were cited for riding on the roadway (FS. 316.2074(5)) where the description of the ticket says "riding on swale, right of way, etc.)

I need sources for a story I am writing, so I need input for my investigation.

Being a reporter, I can only guarantee fairness for all sides. That means I will be writing stories about people who have been terrorized by ATV riders. In all fairness, I have to present all sides of the issue.

For this story, I believe this statute is being incorrectly applied. However, without anyone who can document they successfully beat such a ticket, I have no case law to base anything on.

I can be reached via e-mail at gmcginn@sun-herald.com, or by phone at (941) 429-3000.

I hope to finish my investigation in a day or so before the June 19 meeting.

PS: I am looking for an attorney-member who can speak of trespass law and whether a city can pass an ordinance allowing the police to be agents of a landowner and require written permission. Help on this would be greatly appreciated.

Club Sues Over Blocked Ride

The Pathfinders Motorcycle Club has filed a lawsuit over being stopped from riding in Jamaica, Vermont, in 2004 because of an alleged city law banning ATVs, motorcycles and other vehicles from certain roads.

The suit claims the Jamaica Select Board forced the Windham County Sheriff's Department to enforce a city law banning certain vehicles from certain roads before the law was legally in effect.

The blocked ride, the 5th annual AMA/New England Trail Rider Association-sanctioned Red Fox Turkey Run set for August 8, 2004, was organized by the Pathfinders Motorcycle Club. But before the approximately 300 riders could head off on the ride that morning, officers from the Windham County Sheriff's Department showed up in force at the staging area and told riders they would be arrested if they started riding.

“They threatened me with citation/summons, arrest, and immediate property seizure without due process,” rider Bill Thebert said in a letter to the state Attorney General's Office just after the incident. ``They did so with the sole purpose of preventing me from lawfully operating a 100 percent street-legal motorcycle on public ways within Windham County.'”
