My kids and other youngsters in the neighborhood enjoy riding the atvs in the dried up retention ponds. With that being said we recently received a memo from the home owners associations stating that this was illegal and that when this action is observed the Polk County Sheriff's dept will be called out and the violators will be prosecuted. Our neighborhood is outside city limits and the average lot size is probably about an acre. They are not driving through peoples yards or making a lot of disturbing noises. Is it against the law to play in the ditches and ponds. There are not any rules regarding this situation in the HOA agreement.

Um, yeah. It's illegal and called "trespassing". It usually occurs when someone travels onto property not belonging to them, without the permission of the owner.

You made a statement. Not sure if that's your sole intention or not, but if so, awesome.

Always wanted to go flying through some of the retention ponds that are more like retention abyss's lol. Seen some in Tampa that are gigantic. Like an 1/8th mile or more wide in some directions and the hills were probably 35 percent grade and rolling like it was Kentucky or something haha.

All i know is i got fined by the EPA last year for riding on a dried up lake bed and the fine was hard on the wallet 500 bucks. so i would stay out of the ponds to be on the safe side.
