General / Where to Ride? / Re: ONF is getting insane

Just so everyone knows and understands what really is going on in the Ocala Forest. My friends and I have been riding there off and on for 12 years and have witnessed vast changes from whom, to what is enforced in the forest. Here's the deal; Not everyone who gets hassled by various "enforcement entities" (notice how "law" as intentionally left out) who have the ability to ticket and will, are the same people. You need not have to give an attitude to receive one. You can pull out all of the rules you want and it'll just get you more tickets. The rule for the tires is no rule @ all and is typically written up under the general violation of "destruction of natural resources", in which these people have been trained to use their discretion. This can involve oversize tires, aggressive tread, mud actually on your truck or quad (no matter where it came from), I have never been given a ticket but I have personally witnessed them being handed out. The fine for the destruction is "variable" and based once again upon discretion. This is like "criminal mischeif" laws designed to create a situation where someone can be ticketed or arrested for nothing other than a cop saying so, it's a catch all. The laws recently changed in this state allowing ATV's on public unimproved roads (dirt) with no posted limit or a limit of under 35 unless the local jurisdiction overrides that law with one of their own. The forest is Federal property and does not recognize this law. Once again, they do what they want. The reason for their "generosity" in creating a trail system as it has been described to me is basically to get all the law abiding folks and the ticket book crowd in the same place to generate some revenue (yes, I've had a couple of the rangers whom I've come to know personally over the years tell me this, these are the same people who live there and have for some time and are tired of watching the land be destroyed and actually use some discretion rather than just getting out the ticket book on every occasion). Problems aren't created by who is riding so much as where. If you ride in places where there is mostly just local riders, you see very little problems vs. Big Scrub and the surrounding areas where you see plenty of abuse of power and bad attitudes to go with it. I have seen fines range up to $550.00 and the kicker is, they are federal violations. To "fight" requires more than just arming yourself with a list of Federal Statutes, it requires an attorney and a trip to Tallahassee. If you just decide to ignore it, they don't suspend your license, they issue a federal warrant for your arrest and send the US Marshals to your house. They do a better job of tracking down Forest violators than guys who kidnap kids and take them across state lines to have sex with them. Your best bet is to park off the highway somewhere, carry no forms of ID, that's all I'll say about that.

Today was our first Flattrack race and Hunter (Holliday) wanted me to let everyone know how much fun he had today. That was the first race where he just had fun since his bad MX crash back in Jan. at the SSQSA Live Oak race. Hunter gained some confidence back today and we had a great time. We wanted to thank everyone for putting on a great event; Brady, Dave, Brett, Sheldon, Bill and all of the staff that we ran into today. Overall, it's one of the most impressive events we've ever been to, from the games and bounce houses for the kids, all the way to how friendly all of the staff was and the best trackside concession stand ever! Thanks guys, we can't wait to come back.

See, This is what I'm talking about Matt. You can find a precedent, so can I. You can read and interpret the statutes, so can I. You actually took the time to write basically a brief for your position about which you don't have all the facts, dummy. Furthermore you make certain assumptions. You assume there is a homeowners association, which even if there was, the club itself is not a part of. You assume there is some sort of designation as a construction site (currently). As for any commencement of construction, the permits have been revoked and the order to cease any construction activity has been given. You make a lot more assumptions I won't get into, doesn't matter, they are all false assumptions and I have covered my bases. So I do get to stand on the principal of what I said. In any event you have still failed to realize (which you should) that the people who are in control of the decision making process will remain in control of that process and regardless of what they control, they have the ability to control issues beyond the scope of their own power. I don't need to go on and on as you have. Obviously you have more time than I do so I'll just say this, trust me when I tell you that I'm not "unarmed". BTW, fervor is still spelled f-e-r-v-o-r, not fevor. You still haven't mastered the basic skill of spelling. That's it, now I'm done talking to your ignorant a$$. Say anything else and I'll show you the real type of redneck I am.

You're welcome Jake. Not a lawyer, although I have paid them all several hundred thousand $'s cumulatively. I never just "listened" to a single lawyer I ever paid. I either learned from or questioned them. The State and Federal statutes are much more condensed than the Bible. If people can navigate that literature, then they can do the statutes. BTW, I can read, spell too. Matt, put is spelled w/ a "P", not a "B". I specialize in 4 letter words not 3 "but", I am well versed in them and feel obligated to help you (in a much different way than I have helped Jake). Like I said, "go put your dunce cap on". Jake only needs help w/ the questionable decision of riding a Polaris. You Matt, need help reading AND writing, much more difficult a task. With all your money, I bet Jake would be happy to ride any quad you pay him for. The ability to read, write and spell correctly are priceless. John W. Holliday #68

Sure, you should pay for Jake to race Matt. As for now learn how to read:
810.09 Trespass on property other than structure or conveyance.--
2(d) The offender commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084, if the property trespassed is a construction site that is:
1. Greater than 1 acre in area and is legally posted and identified in substantially the following manner: "THIS AREA IS A DESIGNATED CONSTRUCTION SITE, AND ANYONE WHO TRESPASSES ON THIS PROPERTY COMMITS A FELONY."; or
2. One acre or less in area and is identified as such with a sign that appears prominently, in letters of not less than 2 inches in height, and reads in substantially the following manner: "THIS AREA IS A DESIGNATED CONSTRUCTION SITE, AND ANYONE WHO TRESPASSES ON THIS PROPERTY COMMITS A FELONY." The sign shall be placed at the location on the property where the permits for construction are located. For construction sites of 1 acre or less as provided in this subparagraph, it shall not be necessary to give notice by posting as defined in s. 810.011(5).
In order to supply the Prima facie evidence, just as in the "smaller than 1 acre category", permits are what designate the existence of a "construction site". This prevents know it alls like you (Matt) from just arbitrarily posting their land as "construction sites" for the purpose of elevating the crime.
Here is the part dealing w/ "WHO" can "trespass someone from property other than structure or conveyance": 2(b) If the offender defies an order to leave, personally communicated to the offender by the owner of the premises or by an authorized person,
In the case of "construction sites", which the property in question is not, precedent has given the authority for "authorized persons", which usually also means superintendants, not nosey neighbors. Learn how to read the Statutes before I need to school you some more Matt, you dummy. Now sit there in the corner w/ your dunce cap on.

WTF? Are you retarded? Because permits are "revoked" doesn't make it "not a construction site". Also, the zoning board has nothing to do with issuing permits or reversing a decision once implemented. If they got permits to begin with, zoning has nothing to do with it now. You obviously have no idea what you're talking about and must be telling lies. I call BS out loud on this one.
Besides, why would you want to ride on a construction site in a residential neighborhood? Just to make the rest of us look bad? You're an idiot.
Call BS if you want, doesn't matter. Am I an idiot? Maybe but I will get my 50k back. I own a construction company and know exactly who issues the permits. The zoning board was all that held that process up. So that they would not see litigation in the case is the only reason for allowing the "standard" zoning change. 2 of the board members live here and are cool. The developer is from out of town as are his attorneys. How did you think that would turn out? BTW, I don't ride to piss off my neighbors. The course is 114 acres well lined w/ trees and I'm not the only one who rides it. When others are on the course I can't even hear them in my house (yes, they are the same sound level as mine). Oh, and no permits for construction/no construction materials on site/no posting, means no construction site, idiot. Whens the last time you had $50,000 to lose? That's what I thought. John W. Come ride my course and I'll ride yours! Same story w/ the greedy developers, spent $700,000 on the club house renovations, then tore it down because they thought they could get $500,000 a lot where the club house was. I lost $50,000 on my house appraisal for their greed and now I'm gonna use it. When the cops showed up the first time I told them, "I lost 50k, at about $50 a pop for me and my son to go to my parents and ride in fuel and odds and ends, you can expect to be back out here about 1000 more times." BTW, if the owner or registered agent of the owner are not the compaintants, the cops can't say anything. My neighbors are not all cool, 2 judges, several congressmen, a couple ol' bitties and one doctor who thinks he can do and say whatever he wants and then call the cops when you do the same. So I ride almost daily, just praying that the deputies do arrest me for "trespassing on a construction site, a FELONY!!!!!! (I just happen to know that just like your course, the good old boys on the zoning board were never gonna let it go through and issued his building permits just to revoke them about 3 months ago) Sssssssshhhhhhhhhhhhhhhhhhhhhhhhhhhhh!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

EVS is a great company w/ great products IMO. Hunter and I both use one and in the last 2 SSQSA races our closed cell foam collars performed perfectly. We were both ejected from our quads and both landed on our heads. I was considering the Leatt for Hunter but not for me. I have 2 dessimated discs in my neck and can not afford the space that the Leatt device provides between the helmet and the device itself. The new EVS collar looks like a nice comprimise between the 2! John W. Holliday #68 Hunter N. Holliday #1

Well they say that but just remember, it's all perspective. C= novice. Back years ago that's what that meant. Now, C= C. Novice means you can't make the doubles, can't clear the tables, can't double out rhythm sections, can't rail the corners and can't fully control your quad in mid flight. Most C riders in the SSQSA can do all of these things and rules have been implemented to prevent sandbagging. That doesn't mean that anyone is sandbagging but the A and B classes are so competitive that the C guys are have a hard time moving up. In other words, if you took anyone from the upper end of their respective class in the SSQSA and put them in a national race they would be competitive and many do race the nationals and are competitive.

haha this is a funny post.. But i think im leanin towards the ltr...because i have a stroked motor on a predator right now and it cant run 10 hours straight for anything. and i see alot of stroked ltrs lastin a full season so they seem more dependable. What classes do you guys run? It is funny ! Now I know how you came up w/ the other quad, you already had it! I run SSQSA Adult Stock class, MX only. My LTR is almost done w/ it's second season and I'm not planning on touching it for the 3rd. The Hondas and Yamahas are competitive too, just takes more money to get into one for MX specifically but the used market is full of all of them, already moded out. A lot of Pro's are getting rid of their quads and they can be had for about the same as a brand new quad but w/ 10-15k in mods.

You know, racing a Polaris and trying to defending that decision is a lot like being married to a Schitzo. Probably won't even realize until she pull a Lorena Bobbit on you and throws your junk out in the middle of the woods

Not heated Jake, Just trying to figure out how XC quads see more abuse than MX. Is it the mud? We race in mud about 25% of the races. Trees and rocks? Well, a biffed double and flat landings might be just a bit harder. Tranny abuse? Try being in the air 10% of a moto, everytime you hit it puts stress on the tranny. Doesn't really matter. Can Am has recruited probably the most talented set of racers on one team for the nationals this year, reliability will determine whether they see a championship or not. Polaris has gone all in in a different direction, they bought Wes Miller and the whole H-Bomb crew. "Monkey see monkey do"? Not in that arena. The Can Ams won't stay together and there are still people running from dealer to dealer giving any one of them a deposit that will take one. That's the diff in MX. John W. Holliday #68

Yes, I am a pretty boy ! Thank you! I suppose that Polaris of yours has never given you 1 problem like my Suzuki right? BTW, You can't ride a broken quad, so some don't get rode. Mine has never failed to finish a race, never not started and never quit. Neither has any of my other Suzukis or Yamahas or Hondas for that matter. All I can say for the others is look behind the dealerships of any multi-line dealer and that will tell the story. John #68

Like you said, he wants to race MX. "Monkey see monkey do"? Sure, I guess but if a Polaris could win MX races we would see them out there. They can't, so you won't. If you go to my friend's dealership where he sells Suzuki, Polaris, Arctic Cat and Yamaha, just to name a few, go behind the service department and see what's there. That'll prove the point way better than I ever could. John #68

You didn't crash w/o a helmet did you? Polaris and race in the same sentence is like saying government/health care! Going out to the track and finding 0 outlaws will give you an idea. Yes I ride an LTR for a reason, just like half of the adult class champions in the SSQSA and the Nationals. In stock trim, they don't do anything great but do everything better than the others. Take the extra money that you save on suspension and put it in a combo of motor/steering stabilizer/shock re-valves and your quad can't be beat. John #68

Thanks Brett for giving all of us an opportunity to run a national style series on the state level. Injuries aren't fun and I hated seeing that chopper coming over the track (it was the 3rd time in less than a year that I have seen a rider get airlifted from DC). I had such high hopes for a safe weekend of racing @ Dade City after riding the track in practice. The fact that the ratio of injuries to entries has remained very close is amazing. In all reality the # of injuries should have gone up due to the amount of riders coming off of the gates. Maybe due to the rapid increase in the riders abilities or the quality of the safety equipment just in the last couple years. Don't know but either way I'll take the risks we incur over Hunter hangin' out w/ a bunch of dead end punks w/ no ambition any day. To me, that's a much greater risk. John W. Holliday #68

I know it's a little drive for you but it's not South Carolina!!! Try Nature Coast Motorsports in Crystal River. They are a sponsor of Hunter's and they give everyone a great deal right up front. If you call and ask for Red (The sales manager) @ (352)795-7996 he'll be able to tell you everything you need to know and if you mention my name you might even get another $20 or so knocked off. I have sent friend after friend there and never a regret (besides, I grew up w/ the owner and he's stand up). web site I think is naturecoastmotorsports.com .
