Long time no speak.. Wanna ride ??

7  General / Where to Ride? / Re: Durhamtown on: July 07, 2005, 02:38:49 PM
Just got back from a week at Durhamtown.. WOW!! We had a blast...

From the drag strip..to the trails..to the 4 mx tracks..it was EXCELLENT..

We had a bit of rain and that made for some nasty "red-clay" conditions, but riding those trails in the woods were awesome..

All the trails are one-way..and that eliminates having to look around for "crazy riders" running into you..

Met some really fun people and my son had a great time too.. The cabins are a bit small, but had hot showers and air-conditioning...That's all you need...

One recommendation for Durhamtown..get some washers and dryers so guests can do some laundry...

My only complaint...the drive is SOOOO LOONG....

We need a place in S. Florida  like this...

Th real test comes this weekend when they go back out here riding on the property...

They have a copy of the noise ordinanance statute on hand..I guess they will force the police to get a reading if they want to issue another citation... However, I feel the police LT. has had a chat with the officer involved...

Jupiter is still a small enough town that politics goes a long way..

11  General / Where to Ride? / Re: Ticketed on your own property??? on: April 06, 2005, 08:52:37 AM
VICTORY IS SWEET!!!!

Just a note to thank everyone for giving constructive anbd supportive advice on this thread..

Yesterday my buddy met with a Jupiter Police Leiutenant and discussed the situation rearding the summons. Yes, Jupiter does have a noise ordinance, but since the citation was made during the middle of the day, the general consensus is that it will not hold in Court.

Based on the consultation with the attorney, the ticket will be "thrown out". It appears that the officer issuing the citation was just trying push his weight a bit. AS for the neighbors, they have vowed to call the police until the situation is eliminated....According to the attorney, they will need a petition if they can ever hope to make any progress.

My friend has tried to discuss this with them, but they just want their peace and quiet. He's even asked the neighbors to call him when they are going to be out and he will ride then...These people are in their 70's and have been in Jupiter for 30 years....They just hate kids...

Anyway..it appears to be a victory for the ATV riding public..

Thanks for the replies.

I'm going to tell my buddy to measure the noise decibels of a lawn mower and the bikes ans use that comparison.

My own personal opinion of this is that the Court cannot act on this and must throw the case out..The property is zoned agricultural and it's okay if you put 100 cows out there making noise and stinking up the air, but a few bikes gets the old farts all bent outta shape..

I like the pitbull thing too...His yard is fenced and gated, so that sign thing might get the police to think twice before driving in again... Only kidding!!!

I'd like to see the legal opinion if the owner posts the land with "No Tresspassing" signs.. Does the law have the right to enter?? Obviously if there was a crime being committed, and they were called, they would have a reason the enter, but for a noise complaint in the middle of the afternoon?

Some people just have nothing better to do than complain and make noise.. What do they want our kids to do...go rob their house or something. This is just honest fun and nobody was bothering anyone....

Stay tuned for the details....Nice responses so far.

Perhaps PBSO or someone else can respond to this dilemma.

I have a friend that owns 10 acres of property in Jupiter. He has made a small track through his property and the place is really cool..

Recently, neighbors started calling the police because the noise from riding was making their Saturday and Sunday afternoons less than perfect. After several complaints, the Jupiter Police responded and threatened to ticket the owner for disturbing the peace...Obviously the owner felt that since the property was "private", the police had absolutely no jurisdiction by coming on to his property.

Well, people contined to ride after the police left the scene and they returned again and ticketed the owner. This was at 3pm on a Saturday afternoon...This will go before a judge in Jupiter....Landmark case or what??? Ha! HA!

Let me add that there were supervising adults, no alcohol, no fires or destruction..Just families having fun with their kids. There were 6 people riding...

Do police have jurisdiction to come to your house and tell you to lower your radio too??

14  General / Where to Ride? / Re: Riding at Underhills on: April 01, 2005, 03:00:19 PM
Hey there PBSO and others:

Thanks for taking some time to read this thread. I somehow knew you would get to it and be appalled.

I read the responses to my post and was somewhat shocked that the focus was only on the issue of underage drinking...The issue was that of safety and respect for someone's private property and the "sober" people that ride there with kids and families. We are entitled to be there as much as anyone else...

AS for the people on this thread that support this activity:
To infer that my 12 year-old son will be drinking very soon is ridiculous. It's not the point, and let me assure you that I would not have him riding ATV"s drunk at Underhills late at night at any time soon

If your choice is to drink and drive..go for it, but when it infringes on the rights of others to the point that it endangers their lives...or kids lives, I have a major problem with that...and so will the overwheming majority of the ATV-riding community and law enforcement, and Mr.Underhill for that matter..

I appreciate your opinion and point of view, but cannot respect or support it. I hope you're not one of the 10%.

15  General / Where to Ride? / Re: Riding at Underhills on: April 01, 2005, 07:42:44 AM
Did I actually read here that somebody thinks underage drinking is "acceptable"...??

The response I read is "yeah, that's what they do out there, but a t least they're off the streets".

What's this world coming to?? I'm a single Dad with a 12 year-old son and I would never approve of serving him alcohol. The reason these people up there are out of control and making noise all night is because they are too young to be drinking.. They have no sense of being responsible...

If the "Man" gets wind of this Mr. Underhill will have more problems than he already does up there...He could be the next Michael Jackson case...

17  General / Where to Ride? / Re: Riding at Underhills on: March 31, 2005, 08:35:46 AM
This was a very disturbing thread to read..

I hope that Mr. Underhill bans these people from riding there.

Littering is not tolerable, but destroying personal property, burning someones camper...and vandalism is just not acceptable... These people need to have their a**es beaten.

If the people in PSL find out that this is how their property will be abused then you can surely understand that all of JD's  efforts to find a new place to ride will disappear..

Maybe some friendly warnings from us ATV Florida people will help enforce some of these rules..

Hey Suzi:

Looks like that River Ranch place is a blast.

With all that water though it would be tough for us sport quad guys.

Hope you and Jeff and doing well. Are you going to ride this weekend?

Now we're talking some sense here...

Us ATV'ers get a bad enough name just trying to have fun with our families...Now if we start I-95 sit-downs, we will never get a place to ride or anyone that might want to legally fight on our behalf..

Get behind a guy like JD that's trying to fight to get us all a place to ride in Martin County.  When he's ready to move ahead, he's going to need our strength in number, and our dollars too..

That's where we need to focus our efforts, not pissing off the MAN...

Hey Guys:

We have been chatting with PBSO on another thread and us members here at ATV Florida have to keep a professional attitude when it comes to respecting the law. These guys like PBSO have a job to do, and really will not look the other way if it comes to tracking down a fleeing ATV'er or somebody riding on a public road...

I'm just as frustrated as all of you because we have no place to ride...The question is what do we do??

The only answer I've been able to come up with is find somebody that has property, get written permission to ride there..and don't tell anyone about it.

From what the PBSO guys are saying, if you have permission to ride on private property, they will not be concerned.

Maybe we will get a place someday where we all can ride as a group and have fun together.. I know people like JD are working on that issue...

Until then..happy trails fellow ATV FL members..

Hey JD:

I think you're seeing here that you can probably get enough players on ATV FLorida to give you the initisl investment you would require to fund this project.

Collectively, we are all just looking for a place we can call our own to ride and enjoy..

A Non-Profit Co is a good idea...Great tax benefits and the ability to have a large membership to fund ongoing expansion of ATV riding in the State of Florida..Finally, a voice that will be heard...

Hey:

Have you thought of making a founding members club..Lets say we pay $2500 or so and get some real privileges or something...Like a VIP Club..we get our own reserved camp site...parking, etc.

You could have this thing paid for by tonight...I'm in no matter what the cost.

Hey PBSO:

Have a wet day...

Keep the lines of communication open...

Hey..who's the first guy on the top of the "food chain" we need to start yanking???

tvman
24  General / Where to Ride? / Re: Where to Legally Ride in Palm Beach County on: March 17, 2005, 10:06:13 AM
Thanks to FWC and PBSO for signing on and shedding some light on the subject of riding in PB county.

Now that we are all communicating and have answered the question more than 100 times...It's our turn to take some action and find out how we can put more pressure on the State to get these places that FWC spoke about approved..

Hey FWC, is there some place we can go to monitor the progress of these proposals to approve land use for ATV's?? Why does this seem to be such a secretive thing?? Is it just the red tape, or can we really have a influence on making this process speedy by lobbying?? Who do we lobby to?? Is your fine estimation and knowledge of the system, will we be heard and will our efforts get any response???

It seems like both you and PBSO have a wish list that includes having a place where we will not be making you look like "bad guys". Perhaps all of our collective efforts can bring some real justice to this situation.

ATV's are a real blast and us riders, families and members of ATV Florida are the most concerned individuals you can approach. All we want is to be left alone so we can ride and have fun...

Maybe you guys from FWC and PBSO can meet with some of us and discuss a direction we can take legally to make some real progress...I'd love to get involved in this forum.

PBSO:

Thanks for your replies and interest.

I'm thrilled to hear that you are opening a line of communication with ATV Florida members. For the most part you will find that we are families with children that are just looking for some fun and recreation. We are not criminals or malicious people. Yes, there are a few bad apples, but they will find justice..

As I have said in my previous email, we need to find the right person to target our energy towards...We also need a good attorney. Hopefully on that shares our interest and can do a little digging on the cuff...

Perhaps as a member of ATV Florida you can help us in that fight. You certainly realize our frustrations and can sympathize with our position. Can you make any suggestions or give us a direction we have not exposed??
