Title: Someone PLEASE help!!! Post by: MotoMike on November 18, 2005, 10:48:40 PM I purchased a quad off of this site a little over a month ago. I bought it from "seminolewind" and I paid him $4600 for a 2005 TRX450R. I paid it all by paypal in three payments. I picked up the quad on 10/16. I drove about three hours north to meet the guy. When he got there, he said that he had forgotten the bill of sale and that he would get it to me immediately...along with the manual that he had forgotten at home.
Well, on November 1st, I received a PM from him saying that he had been out of town and he needed my address and he would get the bill of sale out immediately and as soon as he received the title, he would sign it and send it to me. Well, I have tried to contact him many times with no response. Someone please advise what I can do! I need a title or something. Please! Mike Title: Re: Someone PLEASE help!!! If he didn't pay off the quad and you call the police they may take it and let the bank repo it. Not sure how that would work.

He probably didn't pay off the bank and doesn't care because he already has crappy credit or the note is in someone elses name. The bank will be loooking for the quad to repo and will report it stolen. Granted, That is worse case but it looks like it's heading that way.
I would contact the seller and in a polite voice tell him that you really don't want to have to drive all the way to Pensacola to get this cleared up. If you meet them somewhere to buy something and you do not meet them at their house you never really know where they live. He could have stolen the quad and you purchased it and do not have a clue as to who he really is or where he lives. I purchased one and met the person at a parking lot to make the sale much easier for the both of us and come to find out it was stolen. I did get the guy arrested because he tried to sell me another one after I found out but I still did not get my money back. I would almost say that the quad is not his. Another thing is that you can get the vin. number and run it through FDLE to see if its stolen but in my case, I did that but the owner did not know that it was stolen until a week later because she had it stored at a relatives house so that does not always work either.

I took him 2 cashiers checks. One made out to him and one made out to the leinholder for the payoff. That way I knew the machine would be paid off. I also picked it up from his house and we made out a bill of sale.

In the future, never take anything from anyone without writing some kind of bill of sale. I sold my car to an associate of mine and he disappeared for three months without a trace. I had to file a small claims suit against his mother cause he put the car in her name. But if I didn't write out a bill of sale, he coudl've screwed me out of the deal.

You have absolutely no leg to stand on whatsoever. If the loan is not paid off then the bank will come for the quad. Your only chance is to pay the bank the $200 and get the title. Post by: Paul_S on February 15, 2006, 07:38:07 PM If you paid via Paypal, buyer protection would not help you in this case (unless you purchased this at the time), you can dispute these transactions though. If he has some or all the money in his paypal account (which is doubtful - but worth a try) it is very simple to do and it would be very easy to recover your money.
Log into your paypal account and click the resolution center tab and then click the link to "file a claim" and follow the instructions. Other options (well financial ones) depend on how you funded the paypal payments. If it came from a bank account - or was transferred from someone else's paypal account then the above action is all paypal can do for you, if however you funded the paypal transaction via a regular credit card, you can initiate a chargeback through them too. I have all of the documentation from conversations. I told him today that I was going to take him to court if I don't get some action and he then replied. I have PM'd many times with no response, now he says, it take 30-60 days for the company to release the title, but assures that it is on the way to him and he will overnight it to me.

FWIW, I purchased a vehicle from a member on here(QuadFaja) and he had to pay FAR more than this kid had pay on top of it to settle the loan.He did it right off the bat...Ya gotta be careful...It's your problem should they flake out. On the other hand, it does take some time for the banks to "get around" to sending a title out that is paid off..They could careless.You could call for verification though..piece of mind at least. The person with the bike, but not the title has no right to sell the bike. They do not own it, whoever has the title owns it.
I just went to the tax office and registered for title 3 quads. The one I got used from a guy recently. The very first thing that happened on the DMV computer was a pop up on the screen asking for the date that the lein was paid off. When and if this guy ever gets the title, he will also get a letter from the finance institution stating that the loan or lien has been paid off. YOU NEED TO GET A COPY OF THIS STATEMENT FROM HIM ALONG WITH THE TITLE. Also, you will not be getting a title, but a "certificate of origin" from the manufacturer. If he does not send you this lien paid off statement, you need to request from him the date it was paid off. As you have the loan company info and this guys name, I suggest calling them and explaining your situation. I doubt they will come after the bike, but will get on this guy or advice you. NEVER EVER leave a situation without a written bill of sale, you can write it on notebook papare & it will hold weight. If it were me I would have met him at the bank or the Honda shop he bought it from & you could have made sure of the payoff & title to be sent to you asap. You said he met you halfway, well that extra tank of gas isnt looking so bad now. He may be telling you the truth, but the price you paid sounded to good to be true & now we all know it was. If it were me I would drive up there & pay the bank the extra $200 & get the title & write it off as a lesson learned. good luck.
