Title: Re: 5a parking lot Post by: little blue 300 on August 14, 2015, 08:53:32 AM I rode the ONF on Thursday and last night on the way home around 8:30 PM I drove into the parking lot at 5A. It wasn't completely dark yet, but I didn't see any new "No Trespassing" signs or no new fencing. It looked the same way as it always looks, so I would say that it will be opened this weekend. I won't be driving up there again this afternoon as I previously said.
Some day they probably will close this place, but I'm just going to enjoy it while it's here. I only live eight miles from the parking lot and if I hear of them closing it down, I will post on here. ATV trespassers an issue One initial challenge to the development of the area near Deering Parkway in Scottsmoor will be dealing with the numerous all-terrain vehicles that now traverse the property, Brevard County Planning and Zoning Board Chairman Henry Minneboo said during a recent board meeting. “There is a problem there,” Miami Corp. attorney Glenn Storch said. “Especially since they appear to be trespassing, and it’s dangerous. To be honest with you, from a liability standpoint, it’s massive.” Storch said his company plans to put up fences and no-trespassing signs, with tow-away zones, “because you can’t have lawlessness like you have right now down there, and still expect to market this. Arrested, will start after the signs and fences are in place. Everyone should know by now YOU ARE TRESPASSING at 5A. BCSO and VCSO will be coordinating enforcement at both ends of 5A.

With the signs and fences absent they can issue trespass warnings with the authority of the property owner and then if you return it's a chargeable offense. Never the less its the beginning of the end!

810.09 Trespass on property other than structure or conveyance.— (1)(a) A person who, without being authorized, licensed, or invited, willfully enters upon or remains in any property other than a structure or conveyance: 1. As to which notice against entering or remaining is given, either by actual communication to the offender or by posting, fencing, or cultivation as described in s. 810.011; or 2. If the property is the unenclosed curtilage of a dwelling and the offender enters or remains with the intent to commit an offense thereon, other than the offense of trespass, commits the offense of trespass on property other than a structure or conveyance. (b) As used in this section, the term “unenclosed curtilage” means the unenclosed land or grounds, and any outbuildings, that are directly and intimately adjacent to and connected with the dwelling and necessary, convenient, and habitually used in connection with that dwelling. (2)(a) Except as provided in this subsection, trespass on property other than a structure or conveyance is a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083. (b) If the offender defies an order to leave, personally communicated to the offender by the owner of the premises or by an authorized person, or if the offender willfully opens any door, fence, or gate or does any act that exposes animals, crops, or other property to waste, destruction, or freedom; unlawfully dumps litter on property; or trespasses on property other than a structure or conveyance, the offender commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083. I almost didn't go because of all the stuff written on this thread, but figured, " what the heck". I'm retired and this is the only fun that I have. I was getting gas in Scottsmore on the way up and talked to a deputy who also was getting gas. He didn't know anything about 5A closing, but when I said that I hope they don't come in there someday and just start writing tickets, he said that they wouldn't do that without first putting up signs and fences. I hope that he's right. Larry
