I bought a pair of custom axis shocks off of ebay and the guy ended early because he needed the money and because I wanted the shocks...well he never shipped them and ebay banned him so per paypal, there is nothing they can do.  I just lost $765 I am so upset.

I have been calling the seller and he wouldn't answer anymore...just VM.  So I tried *67 and he answered...when I told him it was me, he hung up

Wish there was something to do...just wish I lived in ohio...I would drive to his house and beat his a$$....guaranteed

I am so upset right now, I mean, I have a newborn baby here and every penny counts.  I only have so much I can spend on my bike and for something like this to happen, almost makes me cry...seriously

I have a dispute with paypal and have had one but unless he puts the funds back into his account, all they can do is close his account from further use.

Any suggestions...I am at a loss.

If you used your credit card - the credit card company should fight it for you. If you didn't use a credit card - my advise next time is use a credit card.

I had the same thing happin to me on ebay, won a bid, and he never sent the item.  Tried going through Pay Pal and EBay to get my money back with no results.  But, my PayPal account is set up with my American Express card after disputing with the credit card company I recieved a hold on the money withdraw and a couple of months later was credited back to my card.  PayPal and Ebay's policies on this sucks, luckily I have a good credit card company.

If you have his name and cell number thats all you need. Here's what you do.
Go to every gay website that you can think of and sign up with his name. All you have to do is type one sentence on each website.I would say somrthing like "I love being on my knees" and type his cell number in. His phone will be blowing up in no time. ;)

Man, Mike that sucks. I went through a paypal dispute once and it took months! Like they said, if you used your card you can dispute the charge through them and that is probably the best you can do for now. Even if you went after him in court, you will spend more money fighting it than you lost in the first place.  :(

You need to contact the local authorities and talk to someone about it. You may even try to get ahold of someone at your county court house and try to get some infl through the small claims dept. They may not be able to do anything but i would bet you could get some useful info. This is so common nowadays that theres got to be somethin, you cant tell me that paypal is givin you the :dunno.gif  song and dance. They have to accept some degree of responsibility, or atleast make his personal info available to you, so you can take legal action. I would think. Its just cant be a "we cant help you" type of deal. If so, they would be enabling that type of business to take place.

If you have his name and get proof of payment, you can file a small claims with the court and they'll make him pay .He's probably expecting you to do nothing...take the azzhole to court!!
 It does cost like $400 to file a claim.The amount depends on how much your trying to get back.
 I sold a so called friend a car of mine and he still owed me $2500. cash.He tried to split with my ride.It was like $400. to file the claim, but I got my car back...didn't even need a lawyer.

Also, save your e mails! He ended the auction early so he may try to say that he never sold the item to you. If you guys had an agreement via e mails you need to save every one he sent you and you sent to him. Sorry that this had to happen to you man. E-bay can be good to you, then it can bite you in the arse when you least expect it  :(  .

you can always bring him to small claims court for the cost of several hundred dollars and get a judgement against him.  File the case in fla, he will never attend, you will get a judgement against him, file it in the county he lives in ohio and he will never be able to buy a house until your judgement is paid off and you can collect interest at I believe 8%. You even be able to sell your judgement at a discount and have a collection firm go after him and make his life miserable.  Also try calling directory assistance and give them the # and ask for the address of the #.

WOW...thanks for all the responses!!!!  I have to say reading this has made me feel alot better about the situation. 

Paypal still won't do anything...tried calling again today.  I do however have more info on the guy like full name...:)  I would love to drive to OH and pick up my shocks and definitely will consider that...depending on how things go.

Post all his personal information so we can all call and bug him at all hours of the night.

Have you tried calling the cops, if you go to your local police dept/sheriffs office and present all/any paperwork regarding this transaction they will contact his local police dept. Let them deal with it, a visit from the sheriff/felony theft arrest would probably be all the motivation he needs to complete the transaction.

I am not sure what county you live in, but I know for a fact that our police dept in Madison handle it this way.

Sorry to hear about that. I've had a similar thing happen. I used to live in Ohio. I was just up there last weekend. Too bad I didn't have his info while I was there!!!! 330 area code is around the akron area. I doubt that helps much.

A search says he's a t-mobil cell user in Medina Ohio, Costs $15.00 to get the address. I plugged in his phone# at www.ussearch.com

That's great! Now that we know we have the right guys info, I can give him a call from my job and scare him up a bit. It'll show up on his ID as the Sheriff Dept. Should put alil fire under his bottom to get you those shocks. Let me know ;)

I called the cell number from the original post..could be the email I sent him. I sent an email the day this was posted and advised Chad that legally if he did not want Lisa Pauli or whoever she is to be arrested (that could include felony charges due to the amount being over 500 bucks) that this needed to be handled. I told him I had already talked to the Medina Sheriffs Dept (which I really did) and they would go after who took the money..that all they needed was a police report from the local police here in Florida for them to pursue it and make and attempt to scare them into paying this back.

Funny as I was typing this he just called me again..


I know he is not a nice guy for what he has done to Mike but I have to say he is really nice to me. Mike if ya need anything else please get in touch with me..

I just really hope he did ship them.

Ok well me and Mr Chad are really getting into it now (text messages). I just hope everyone here has my back cause he had stopped being nice to me for a minute- that is until I convinced him that different states carry different laws boy oh boy did his tone change.  I have no clue about different laws but boy I can sure sound like I do..lol. (I did talk to the sheriffs in Medina County,OH again and they told me it depends on how the police report is filed what they can do - they now know my name lol I talked to them so much) 

Motomike - we need to 3way call him when I get off work (he knows my number and will take the call) are you going to be available? Also will you send me your number in a pm please so I can talk to you? 

On the text messages does anyone know is there any way to get a written copy of the text messages that have gone back and forth between our phones or is that just on CSI. lol

On another note I will know by tonight when I get off work what will be the final outcome as I am not 100% these have shipped.

I am glad you guys are getting around to involving the police. As I said in an earlier post, if you contact your local police dept, they will forward the case to his local police dept and he will have to send your shocks or return your money, anything else is a felony.

I own a web site www.tackoutlet.com and have had the local cops here, sent from someone in Colorado who was pissed at having to wait the 10 business days I hold their checks for. So it does work.

This dude is a Jackass! He's basically trying to make excuses as to why he's sending you through all of this. And he thinks maybe that you're bluffing with him about the pressing charges and all too. He had no intentions on sending you anything and you need to have your ducks inline b/c he may decide to try you.

Yeah, well I ain't got nothing to loose by pressing charges or anything else...thats one thing he musn't forget.

also if he gives you a tracking number and on ups.com it says 1 package at xxLBS don't drop the dispute. A lot of people will put rocks, bricks or books to make it look like your getting it and then you drop everything by time you actually get the goods.

Here it is 5 days later... WHAT HAPPENED? Did you get the shocks?

Nope still haven't received them.  However, he did give me a USPS tracking number but nothing is coming up yet (common with USPS).  I have left all of my claims open, just in case.

Well, I got them!  Its funny, he said, they are 19 3/4 of an inch but I just measured them and they are 19 1/4...no biggie but he is an idiot.

The day I received them (about 2 hrs after I picked them up from USPS) I received a call from him telling me that he seen that I received them and wanted to know why I hadn't removed my claims...lol  What a schmuck!  He actually wanted me to rush when it took him months and many threats for me to get my stuff!!!!

Either way, today I removed my claims on paypal, just as I said I would.

THANK YOU EVERYONE FOR WHAT YOU DID!!!!  I AM TRUELY GRATEFUL AND AM INDEBTED TO ALL OF YOU!!!!
