question to the atv family. i am planning seminole tomorrow and taking one of my sons friend. am i being paranoid asking the parents to sign a release form for ME. the kid is a really cool kid and i know hes responsible and knows how to ride good but god forbid something happens i want to make sure i am not  gonna be held liable. i'm kinda embarrassed asking them to sign it. a fellow forum poster advised me to make sure they signed it and thats what i am doing.what do yall think. -

paranoia or sensible.

Very sensible, the whole family might be cool but that could all change the second he got hurt. With lawyers the way they are today its a great idea and i believe everyone should do it.

just explain it to them like that. "hey this is kinda embarassing but he is going to be riding a motorized vehical and i just wanted to be clear that he had your permission" that should go over fine, if not then they are the kind of people that would sue you any way so leave the kid at home.

Friends are friends but how many times have you seen friends get vicious when poop hit’s the fan??? Cover your butt Gerry because nobody else is….  You do what most men learn in there lives, and that is to look far down the road.. You go out there tomorrow and the kid fly’s off the handle bars because a tree jumped in front of him, who does the ultimate responsibility fall on? You because you are the guardian  on site and you are responsible for him…. Just my 2 cents.  When poop hit’s the fan they are always going to blame the party who was left accountable.

if it makes you feel better than have them sign it but in the state of florida it will not matter. they can still sue you! there is no waiver written that will hold up in court. sorry to say that but i felt you should know before you made a final decission.

Gery - I am a licenced claims adjuster and I deal with lawyers all day long.....make sure the wording on the release has to be perfect and the release is notarized and if forbid something might happen that will help your case a bit

thanks guys for all your support. went out on thje track for the first time and it was awesome.  i was on the wrong bike for a track(warrior) but i just took it easy and had a good time.
