Please if you know what type of snake it is tell me. <a href="http://photobucket.com/" target="_blank"><img src="http://i21.photobucket.com/albums/b251/daviesjpg/KennySnake002.jpg" border="0" alt="Photobucket - Video and Image Hosting"></a>

One way to tell.  Have your brother put his finger in it's mouth; If it tries to swallow it, its a rat snake, if it bites it with two little hooky-like things and his finger and hand swells up the size of an elephant's nut sack, it's a baby moccasin!

Just kidding do not try this at home! Huh

10-4 But I am leaning toward water snake. round eyes will confirm, cat eyes = leave it alone!!  OR.......... When it bites you........if it leaves TWO puncture wounds and feels like someone hit you with a fire poker its a moccasin. You choose the way you wish to find out!!

Bottom line if you are not SURE LEAVE IT ALONE!!!!

Easy way to find out... Jam a shovel through it's neck. Let it sit ouside for 2 days and take the carcas to the vet. They'll tell you what it is.

No doubt that is a water moccasin aka cotton mouth.  I have seen them enough to know, he is very very lucky.  I have caught a few snakes in my time, yea I know, makes hubby real happy, but that's one I would never mess with.  They are extremely fast....

PS if you are ever fishing with a top lure, and one is following, don't keep reeling to your jon-boat.  Don't ask me how I know.. lol

But seriously, that is a very dangerous snake, because they are very aggressive, more so than a rattler.

cotton mouths are the only snake I've ever seen CHASE a human or large animal.

I'd say the only thing to do with that one is to make like you are twirling a lasso above your head and fling it by the head as far away from you as you can,,,,preferrably towards a neighbor that doesn't like ATVs ;-)

I heard someone caught a snake this weekend, I don't think it was a cotton mouth though.  Atleast not at first.  I'm sure it wouldn't approved of being twirled over head though. Shocked  Might give a hernia trying to lift the thing too.
